The concept of “surrogate motherhood” involves an agreement between a surrogate mother on the one hand – and a couple or one person on the other hand, for the surrogate mother to carry, give birth, and then transfer the child to the latter, most often referred to as the intended parent / parents.

A surrogacy agreement is a commitment made by a woman (surrogate mother) to carry a child for another person or couple (committing parents), with the latter offering to take over the future care of the child.

How does surrogate motherhood work in Ukraine

First of all, in order to officially participate in the surrogate motherhood program, an agreement is concluded between the parties. It is the contract that regulates the relationship between the parties, thus ensuring the fulfillment of their obligations by each of the parties. The drawn up contract is notarized.

The contract on surrogate motherhood prescribes all the points regarding:
